The legal status of the equity investment fund in the private international law

Abstract

The legal status as a complex legal construction comprises a number of elements that are characterized by the different functional capacity. They determine the purpose, terms of the establishment and termination, characteristics of activity, organizational structure and liability with regards to such ideal subjects of law as legal persons. In the present paper we will try to analyze the structure of the legal status inherent to the participants of the collective investment activity in the Russian Federation and answer the question, whether it meets the terms of the free cross-border movement of the persons and capital.
